Company President James Moore has promised repeatedly that nothing will be built in Harris Hollow that the majority of county citizens oppose, and has indicated his willingness to cooperate by amending the special use permit application so as to prevent his ski-alpine slide area from turning into another “Kings Dominion.” He has proceeded with his application on the understanding that Rappahannock s Commonwealth Attorney believes BZA Vapproval is not even necessary.
The Board of Zoning Appeals should be certain these promises are honored. If they vote to issue the special use permit, the wording should be very careful, very precise and very specific.
While the BZA members may face a court suit if they turn it down, we don’t think a court in Virginia will challenge their right to attach conditions which protect the interests of Rappahannock County.
The Board of Zoning Appeals should be certain, however, that these promises are locked very specifically into its action on the application. While we are fortunate in the high quality and reputation of this applicant /owner of the ski area, things and owners have a natural way of changing with time. Under this sole condition, we feel the project should be approved and then strongly supported here for the bright prospects it holds as the right thing in the right place at the right time in the best long range interests of all of Rappahannock County.
