SkHng Denied? Despite the clear wording in the BZA's denial of the use permit as submitted, confusion has arisen. Douglas Baumgardner, attorney for the ski area, immediately asked for clarification of the BZA’s ruling after Thursday’s meeting. He was told by Muth and BZA Chairman Josef Gardiner that the denial covered rights to a ski operation and other uses allowed legally under the grandfather clause prior to the area’s last bankruptcy several years ago. "I asked the same question two or three times to make sure there was no mistake on what the ruling was,” Baumgardner later maintained.
