The denial of the special permit concerned only new requested uses—specifically the snowless Alpine slide, Gardiner said. “That’s what we focused on and that’s what we denied,” he stated.
Other BZA members contacted on Tuesday weren’t so sure. Both Hal Forward and George Muth interpreted Thursday’s unanimous vote as a denial of ALL the uses—including skiing— asked for in the application submitted December 27. According to Muth, the other BZA members (including Gardiner) concurred with this position.
There is a further question regarding Admiral Gardiner’s contention that the ski area already had the right, under the grandfather clause to resume skiing operations without a use oermit.
