Jack J. Atkins of Amissville announced his withdrawal last week from the contest for Jackson District supervisor in the upcoming November general election. His action leaves incumbent J. R. Latham running unopposed.
Atkins made his decision after receiving letters from Harold C. King, Commissioner of the Virginia Department of Highways and Transportation, and C. D. Garvey, Jr., resident engineer with the Department’s Manassas office.
According to a letter dated July 27 from King to Atkins’ attorney Sharon Genebach Luke, Atkins’ candidacy presents an “inherent conflict.” King acknowledged that Atkins’ candidacy for the Rappahannock Board of Supervisors violated neither state conflict of interest law nor provisions for the federal Hatch Act that prohibits public employees from seeking most elected offices.
“Notwithstanding that, I feel the Department has a legitimate interest in controlling any external activity of an employee which represents a real or potential conflict of interest between the public trust held by the Department and the constituency of a candidate for public office,” Kind wrote.
“By law, Boards of Supervisors play a dominant role in determining the priorities by which many Department construction and maintenance activities are controlled within county jurisdictions," the Commissioner continued. “Mr. Atkins’ service on the Rappahannock Board would require that he pass judgement on recommendations of the Department management he serves as an employee, while responding to the interests of a public constituency he
