In many counties, the board of zoning appeals is just that—an appeals board that hears only appeals of decisions made by others. Here in Rappahannock, however, the BZA serves almost a legislative function by issuing special use permits and variances to the county’s zoning law.
In the past, the county has found itself embroiled in litagation arising from decisions made by the BZA. This happened with P.E. Steve Dement’s Sperryville antique business, with the Harris Hollow ski area and proposed Alpine Slide, and most recently with the Nationwide Pentacostal Evangelistic Association’s Castleton campground.
Time after time, the BZA has issued permits after-the-fact for construction that was already completed. In other cases, permits have been granted on the basis of hardship when not a shred of evidence has been presented which would demonstrate hardship and when the only mention of the word came in the BZA’s motion to grant the permit request.
