Douglas said that at another time he wants to raise the issue of Baumgardner’s conduct as it relates to the deposition supplied to Dr. Dimitris. “It's irritated me to the point where I don’t even feel rational today," he admitted.

In his sentencing argument, the commonwealth's attorney noted that Douglas has been convicted by a jury of a serious felony. “He shot a man in the back, attempted to gun him down” and then fled from the county, Baumgardner started, noting the defendant was still armed when arrested.
He pointed out that Douglas has four prior felony convictions as well. “Three relate to very serious crimes of violence—three counts of attempted murder."
In addition, Baumgardner said, Douglas shows no remorse and instead maintains that what he did was right. "I submit that the court has no alternative but to sentence him to serve 15 years in the penitentiary," the commonwealth’s attorney concluded.
