Each pled not guilty to the petty larceny charge and each was given a chance to testify separately.
Roger Cave testified that he was in the vicinity of the Corner Store on the afternoon in question. “I was drunk,” he said. ‘‘When the man yelled that the law was coming 1 ran in a hurry because I didn’t want a drunk in public charge. I had
nothing to do with any beer.”
Dave Nichols said that he had pulled into the Comer Store lot to let a passenger use the bathroom. “When 1 heard that they’d called the law I pulled away because I was pretty high. We had a whole cooler full of beer in the car. We didn’t need any more beer. Then I got hung up on that wire and rocks.”
John Ronald Jenkins testified that he was passed out in the car at the time of the attempted burglary. “I was passed out the whole time. In fact, it was the noise
