After receiving copies of the letter from Eastham and two letters from Konick. chairman Massie said on Tuesday night that she discussed the situation with superintendent Robert Estabrook. At her direction, she said. Estabrook asked the commonwealth’s attorney for a ruling. Massie reported that Baumgardner felt it would be better to go ahead and file the permit application in order to avoid any controversy.
The attorney acknowledged that a point of law exists as to whether the school board must secure the permit, Estabrook noted, but added that Baumgardner did not anticipate denial of the permit application.
"That sounds like the simplest way,” agreed board member Nancy Reeve. "We can pursue the possible legal point if we're turned down.”
Massie asked for a motion to make the permit application; Reeve made the motion and Nelson Lane seconded.
It brought Eastham to his feet, objecting loudly.
Massie emphasized that the board was acting on legal advice.
No Advice
"From Mr. Stone. Mrs. Massie? From Mr. Stone, Mrs. Massie?" Eastham demanded, leaning across the table to shout in her face and repeating his question again and again. “Don't tell us you got legal advice when you didn't!"
Weilding her gavel in an attempt to restore order, Massie insisted "I’m not going to be intimidated.” he voice never rising.
"And I'm not going to be bamboozled!" Eastham shouted, accusing the chairman of attempting to destroy the county’s educational system with her request for a motion to file the permit application. Apply for the permit will put the school system "under the thumb of the zoning administrator!" the Wakefield representative bellowed.
"I will not tolerate this." Massie interjected in between Easlham's outbursts.
"1 will not tolerate putting the schools under the thumb of the zoning administrator!" he screamed back. "Damn it. conduct this meeting in order!" He criticized Massie’s request for a motion, charging that she was "asking this poor boy (Nelson Lane) to vote when he doesn't even know what the hell he’s talking about!" Eastham launched a long harangue on the precedent set by the permit application, describing the commonwealth’s attorney's advice to go ahead and file as “rinkv-dink.”
Ruled repeatedly out of order by the chair. Eastham volunteered to leave the meeting. "1 will go!" he announced loudly, only to have Massie reply with a request for calm discussion.
