“The zoning administrator didn t have the power to make the determination (of approval for the landfill) in the first place so he shouldn't be authorized to make the redetermination," stated BZA member Peter Kramer. "It’s a large enough problem...This board ought to review it."
Chairman Lee Bird and member George Muth (who was on the board when the original permit was granted both agreed with Kramer that (1) the permit granted in 1977 for operation of a landfill had expired and (2) the BZA should make the determination of whether the permit should be renewed following a public hearing set for November 5. In response to Swindler's contention that the landfill operation is the Board of Supervisors’ problem. Bird maintained that this becomes the case only if the dump permit isn’t renewed.
