When Mrs. Matthews learned that the amendment had been added to the ordinance after the builder applied for Mrs. Smith’s building permit, she changed her vote and the variance passed on a 3-1 vote, with Mr. Zindel voting against it.

The variance is conditioned on Mrs. Smith acquiring additional land from the one neighbor and building a fence between her property and Mrs. Dodson’s.

At the Planning Commission meeting earlier this month Mr. Gottlieb and Mr. Zindel asked the planners for suggestions on how such applications could be avoided.

“We have a situation where a law has been broken,” Mr. Gottlieb said. “A law that is not enforced is worse than no law at all.”
