Deputy Connie Compton contended that she had permission to search the trailer from Mrs. Warren’s husband, who was present in the trailer. Mrs. Warren said she did not.
Mrs. Warren said that she and her husband had “an eight day marriage,” and she blamed him for the fire which burned down her house last winter. \
According to Deputy Compton, she was called to the.residence by Mrs. Warren, who wanted her to remove her husband, claiming that he was drunk and disorderly. She also claimed that he had been violent, shooting out two tires on her truck and striking her.
Deputy Compton said that Mrs. Warren gave her consent to enter the trailer, where Mr. Warren was asleep. When Deputy Compton got inside, she said she saw the butt of a gun in plain view, sticking out from between the boxspring and mattress on which Mr. Warren lay. She said that he subsequently woke up and gave her consent to search the rest of the trailer. She said that she found another firearm on the premises. Mrs. Warren was charged with possession of a firearm while being a convicted felon.
In a plea agreement with the Commonwealth, Samuel L. Robinson, 25, of Washington, pleaded guilty to malicious wounding, while maintaining that he did not commit the crime. Mr. Robinson has been tried twice for the inci lent which allegedly occurred at the Pine Knot Inn in November, 1992. He was charged "ith maliciously wounding Walter Freeman, .mong other charges. He was previously found guilty of brandishing a firearm, which is a misdemeanor.
If the com t accepts the plea agreement, Mr. Robinson pt be sentenced to-12 years in the penitentiary, with six years suspended for the malicious vounding charge, and 12 months to serve for the brandishing a firearm charge, for a total of seven years to be sewed. He will also be on supervised probation for five years upon his release and will be required to pay restitut on of $15,596.98 for medical bills within five years of his release.
