Bruce Wallinger, a Harrisonburg, Va. attorney representing the Inn, said that "if drinks or meals were given on the house, there's not a record kept."
Wallinger explained the restaurant's process of record keeping and at one point held in the air an 8 and a half by 11 inch envelope stuffed with documents three to four inches thick and told the judge, "Here's one day’s report (of dining receipts and restaurant record keeping). It wouldn't show the answers to the questions Mr. Konick is asking."
Andrew Welch, general manager of the Inn, took the stand and in addition to explaining how the Inn keeps its dining records, he answered questions from Konick about who has authority to give guests complimentary food and drink.
"I do," said Welch.
"Who else," asked Konick.
Welch replied O'Connell and Lynch, the owners, "and on occasion, the director of dining services, Simon Pound."
"Do you know any members of the Town Council,” asked Konick. "Do you know Claudia Mitchell?"
"I do."
"If she walked in the door, you would know her?"
