Deputy Fincham corroborated Henderson and his stepsister’s testimony that Buettner was intoxicated on the night in question, according to Luke.
Luke said the reason that Henderson and his stepsister waited until Sept. 20, 2008 to obtain a warrant for Buettner’s arrest was because Henderson injured his left leg seriously in a Dec. 19, 2007 automobile crash and he was unable to travel to Rappahannock County until September.
Luke also said Buettner’s conviction would not automatically remove him from his seat on the Winchester City Council.
