NOTICE OF JOINT PUBLIC HEARING AND

INTENTION TO ADOPT A COMPREHENSIVE

SEWER ORDINANCE BY THE TOWN OF

WASHINGTON. VIRGINIA

KINDLY TAKE NOTICE that the Town Council and Planning Commission of the Town of Washington. Virginia will hold a joint public hearing on the 11th day of March, 2009, beginning at 7:30 p.m. at the Town Hall of Washington, Virginia to consider the adoption of a comprehensive sewer ordinance which provides, by way of summary, tor the establishment of Availability Assessments and tap fees, the same being for structures and uses that existed as of January 1, 2009, $7,500.00 for each residential unit, except apartment units which shall be $3,750.00 per unit, and for nonresidential users, $7,500.00 for each equivalent EDU unit, an EDU being the historical average monthly water usage divided by 6,000 gallons multiplied by a peak load factor of 1.4, or for restaurants 1.7; a User Assessment of $19.50 per month for each potential user whether connected or not, and if connected, for each up to 2,000 gallons per month of water usage, and $11.75 per thousand gallons thereafter; the establishment of the service district for Phase I of the sewer_system, provision that every structure and user in the service district must connect to the system and pay the Availability Assessment and fees and the base monthly charge of $19.50 whether actually connecting to the system or not, establishing that all connection assessment and fees must be paid to the Town by residential users in five equal annual installments beginning October 1, 2009 and that non-residential users pay such Assessments and fees in six annual installments beginning October 1, 2009 and if any installment is not so paid a penalty of 10% and interest of 10% for each such installment which shall become liens against the property of such person; a requirement that each user provide 220 volt power an4 a sewer connection to the grinder pump at the user s expense; that each user must provide an easement to the Town for installation of the grinder pump and access to such pump for maintenance thereafter; a prohibition of discharge of storm water into the system; provisions for pretreatment of waste water; reporting requirements; requirements for waste water discharge permit; provisions and prohibition as to the discharge of certain classes and types of substances, wastes and/or hazardous wastes into the system; and provision of civil and criminal penalties for violation of provisions of the ordinance The tap fees and Availability Assessments for structures and uses not existing on January 1, 2009, or for those who do not agree in writing and furnish sewer easements by April 1, 2009 to connect to the sewer system, shall be $15,000 00 per unit or EDU The foregoing ordinance is a comprehensive waste water ordinance dealing with all aspects of connection and user costs and user responsibilities and restrictions. A complete copy of the proposed ordinance is available at the town offices, the Circuit Court Clerk s Office and John McCarthy s Office during normal business hours. The Town Council and Planning Commission will hold on the same date and time a public heanng to adopt a separate sewer service district ordinance establishing a service district for provision of sewer services. Council has authonty to impose these charges and fees by the provisions of Section 15.2-2400 through 2413 and by the provisions of Sections 15.2-2109 through 2122 of the Virginia Code All are invited to attend the public hearing at the time and place aforesaid and present their views.
