Miller’s description of the procedure Was right. Baumgardner had said earlier that an advertised public hearing was necessary so that adjoining landowners .could be informed of a possible change in land use and have an opportunity to comment. But, Baumgardner said he saw Newbill Miller’s point, if no change is made, no one is affected.

CHAIRMAN Herbert Barksdale was ready to vote. “What’s the use of all this foolishness? We can’t approve it,” he said. Jim White agreed that the planners would probably vote not to approve the request, said, “I’d hate to see you get knocked down on a procedural matter.” To be safe, the planners ought to have a hearing, White said; besides, he was convinced it was required.

“Newbill, you worked on this ordinance pretty near 15 years, what do you think?” Herbert Barksdale asked Newbill Miller.

Miller was still convinced that a hearing was necessary only when the zoning law was changed.

“Then we’re doing it legally,” Herbert Barksdale said. David Fannon made a motion to deny the rezoning request and Allen Stokes
