The planners went on to other business, but once those matters were taken care of, they came back to the question of the hearing. Fanning Baumgardner had rechecked the zoning ordinance and read another section. From that, it was clear “all opinions must be heard in a legally advertised public hearing” before the planning commissioners can vote.
HEARING that, David Fannon laughed. “I’ll withdraw that motion.” Herbert Barksdale smiled and murmured something about “despite the fact we’ve been living illegally all these years, we’ll start being legal now.”
Newbill Miller grinned a bit sheepishly. “Mr. Chairman, I was out of order. You do have a right to deny a subdivision variance without a hearing, not a rezoning request.”
Baumgardner said the planners could advertise to have the hearing at their next regular meeting and invite the Supervisors to come. Newbill Miller said he thought Supervisor Chairman Pete Luke had said he didn’t want any more
