He noted that heirs who didn’t participate in the decision to place an easement on land would be another matter but predicted that they too would have difficulties fighting the action. "If the husband and wife sold the property outright and gave the proceeds to charity, 1 can’t see what basis the heirs would have for fighting that...An easement is the same thing,” a charitable donation, he maintained.
Col. Nels Parsons plans to place his acres outside Washington into the easement program because he believes in committing the land “in perpetuity to staying like it is...a source of pleasure for people, a wildlife preserve.”
“I see no risk associated with it at all,” said Parsons. Noting that he hadn’t explored possible tax advantages available through the donation of an easement, Parsons stated that this wasn’t his motivation. "But I will look into it,” he added.
He described the open space easement program as “one of the answers I see to developers chopping up the county into five acre lots...to pockmarking the hillsides with houses.”
Parsons plans to actively solicit other landowners for the open space program. “I hope to make it spread like a disease,” he concluded.
