If property is undeveloped or - in agricultural use, it meets the broad qualifications as open space. More specifically, land in urban or rural areas that is scenic, forested, adjacent to an existing or proposed park, or near a scenic road, river, marsh, steep slope or floodplain qualifies as open space and should be considered for protection. 4. Who may .give an easement?
The owner of record may give an easement restricting the use of his land. In cases where there is a lien against the property, the lienholder must agree to the terms of the easement. It has been the past experience of the Virginia Outdoors Foundation that most banks and lending institutions are sympathetic to the purpose of open space protection and are willing to subordinate their liens to the terms of the easement. The Foundation will assist the landowner in negotiations with the lienholder. 5. What agencies accept and adminster open space easements?
