We are disappointed, however, that | Gardiner has chosen to poll the BZA members for their decision on the ski area’s application rather than calling the Board back into session for a vote. Polling members by telephone will, in effect, be taking action in a closed session. We don’t think this approach is fair to the hundreds of Rappahannock < citizens who demonstrated such interest 1 in the outcome of the ski area's request. We have some doubts if it’s legal, under the Virginia Freedom of Information statutes.
We’re not suggesting that the BZA Chairman reopen the public hearing for further testimony. We think that probably everything that needs to be said has been said—some of it many times over. But we think that the Board members should go back into open, public session for an open, public vote.
