Bidden Related To Architect
The attorney went on to say that a proper way of handling the fact that Lowell Baughan, the architect, was related to two of the principal members of the construction company that turned in the previous low bid was to publicly acknowledge the fact, and to determine if this relationship had been a problem in any prior construction jobs where the same relationship existed.
“This man has an excellent reputation,” Stone said. “In rural areas there are always familial, social, personal ties between people. Your duty to your constituents will be fulfilled by this acknowledgement and this research.”
Eastham also had a question about the acceptance by the architect of a certified check for 5 percent of the project’s value in lieu of a performance and pay bond with the bid. The architect and the attorney both explained that the job could not proceed to contract stage without the bond. “The check just enables a contractor to put in a bid in the event that his bid bond doesn’t arrive when he expected it,” the architect said.
