Under the statute, it is not necessary for the Commonwealth to prove that the defendant had committed a moving violation while driving. The Commonwealth must only prove that the he has been convicted as a habitual offender, and that he drove a motor vehicle on a highway in Virginia to establish his guilt. Conviction carries a possible mandatory prison term of from one to five years. The sentence cannot be suspended.
Animal killing certified
Former Rappahannock County Sheriff s Department employee Jerry Ashby Compton, 24, of Route 1, Box 178, Castleton, was indicted by the grand jury on a felony charge of maliciously killing livestock.
The charge resulted from a Sheriffs Department investigation in November 1988, into the killing of a hog owned by Dale Welch of Huntly. A complaint filed by Capt. Ed Streapy alleged that on Nov. 10 Compton and two juveniles killed the hog and stole it with the intention of having it butchered and selling the meat.^
