Mr. Zindel said he had worked in other jurisdictions that require a wall check. He said some of the variance requests had been triggered when the owner tries to sell the property. “My compassionate compatriots oh the BZA don’t force people to move their houses.” he said. “We hate to add these expenses, but how do we control it?”

Jackson District representative Ellis Bingham suggested that when the building inspector inspects footers he demand a wall check if he is uncertain that the building meets setback requirements.

Mr. Zindel said that would put too much responsibility on the building inspector.

Piedmont District representative Charles K. “Pete” Estes agreed with Col. Bingham saying, “It is not too much for the building inspectoi^o determine whether he needs a wall check.” He noted that some surveys cost over $2,000. *■ Mr. Gilkey asked Commonswealth’s Attorney Peter Luke if the county or building inspector would . be liable if he required a wall check ■and the house turned out to meet setback requirements.

Mr. Luke said he was not sure.

“The only way .to insulate him \\^ld be to build criteria in here thaftk) not make it so subjective,” he added:
