Most VIJAC members, including Mr. Rosenbluth, say the current law creates a frustrating situation for victims and/or their families when they face exclusion from the courtroom.
“We were forced to sit outside the courtroom on a bench and watch on a monitor,” said Mr. Rosenbluth, whose son and daughterin-law were shot and killed in their Chesterfield County home in 1993.
Stephen Dalton, a Richmond defense attorney and former law partner of Attorney General James S. Gilmore 111, said the law that excludes material witnesses from the courtroom resulted from the courts’ experiences with this matter.
Although not intentional, he said, witnesses can and do change their testimonies after hearing others testify in the courtroom.
