Yet, in its present form the proposed amendment fails to prov ide a form of recourse if the responding agency does not do its job. A provision at the end of the amendment states that there is “no course of action for compensation or damages” if the mandates in the amendment are not followed.

Mr. Gwynn disagreed with this statement.

“If a prosecutor’s office is doing their job, they should already be doing everything in this amendment,” he said. “If they aren't, you do have recourse — you boot the commonwealth attorney out of office in the next election.”Mr. Rosenbluth also proposes refusing bail before the trail of any person arrested for violent crimes.

While some panelists agreed with Mr. Rosenbluth’s premise and intentions, they opposed the overall concept because in the United States an arrest does not mean guilt — people are innocent until proven guilty in a court of law .
