cil unanimously approved, by roll call vote, John Baumgardner’s street survey following a public hearing. Town attorney Frank Reynolds explained the proposed resolution. “The survey was commissioned because the town council felt landowners and the government needed to know where the streets actually are.” Reynolds and zoning commissioner/county administrator John McCarthy recommended the survey based on state law requirements.
“The purpose,” said Reynolds, “was not to determine where streets should be, but where they are. There was no place in the survey where land was taken that was claimed by another person. There was no adverse possession, but after 20 years of use as a street, the property is conclusively considered a street.” According to Reynolds, there are many places in the county where property owners own to the middle or the whole of a street.
