THE OBJECT of the above-styled suit is to release the lien of a deed of trust executed by Complainant dated November 2, 1978 and recorded in Deed Book 129 at Page 734 in the Circuit Court Clerk’s Office of this Court, securing the repayment of a note in the original principal sum of $26,500.00 payable to Mary Ellen Bailey Hall, and encumbering the following real property situated in Rappahannock County, Virginia and more particularly described as follows:

Lot B, MAY HALL “BEL AIR" lot, County of

Rappahannock, as the same is dedicated,

platted and recorded as Instrument #1030

on October 24, 1978 at 3:00 P.M. in the

Office of the Clerk of the Circuit Court of

Rappahannock County, Virginia.

AND BEING the same and identical land

conveyed to Violet Wood Embrey (formerly

known as Violet Virginia Wood) by deed

from Mary Ellen Bailey-Hall, widow, dated

November 2, 1978 aria recorded November

8, 1978 in Deed'Book 129, page 731 in

the Clerk’s Office of the Circuit Court of

Rappahannock County, Virginia.

And it appearing by affidavit filed according to law that due diligence has been used by or on behalf of the Complainant to ascertain in what county, city or state the Defendant MARY ELLEN BAILEY HALL resides, if she be still living, without effect; and,

If further appearing that the above-named Defendant TERRI ELLEN HALL, individually and as Trustee of the aforementioned deed of trust, is not a resident of the Commonwealth of Virginia and her last known post office address is 4427 Shalimar Avenue, Las Vegas, Nevada 89115; that the above-named Defendant WARREN WINES is not a resident of the Commonwealth of Virginia, and his last known post office address is P.O. Box 560, Williamsport, Maryland 21795; and,

It further appearing that the heirs at law of MARY ELLEN BAILPi' HALL, who now is or may be deceased, and whose names are unknown, are or may be interested in the subject note and deed of trust to be released in this suit, if any such heirs at law there be.

It is therefore ORDERED that all such persons claiming an interest in the land above described appear on or before the 25'r day of February, 2003 in the Clerk’s Office of the Circuit Court of Rappahannock County, Virginia, Post Office Box 517, 238 Gay Street, Washington, Virginia, 22747, and do what is necessary to protect their interest.

It is further ORDERED that this order by published once a week for four successive weeks in the Rappahannock News, a newspaper of general circulation in the County of Rappahannock; that a copy of this order be posted at the front door of the courthouse wherein this court is held; and that a copy of this order be mailed to each defendant at the address shown by the aforesaid affidavit and which is listed above.
