The object of the above styled suit is to have the court construe the will of W. G. Dearing, deceased; to have the guidance and supervision of the court in the administration of the Estate of W. G. Dearing and to construe and determine the meaning of the trusts created by the will and to appoint trustees thereunder and to determine the beneficiaries, legatees and devisees under said will and trusts created therein ; and to settle all matters arising in the administration of the estate and trusts created' in the will.
And it appearing by an affidavit filed according to law that A. Willis Dearing is not a resident of the State of Virginia and that The Southern Baptist Theological Seminary is a corporation not domesticated in the State of Virginia but is a foreign corporation not doing business in Virginia and not having a statutorv
