The case of Commonwealth vs. Raymond Dearing was heard In the Circuit Court of Rappahannock county, Friday, July 28. The defendant, Dearing, was represented by James W. Fletcher of Sperryville; Wilbur Trout of Front Royal appeared on behalf of the Updike family, and R. V. Snead represented the Commonwealth.
Dearing entered a plea of guilty to all charges against him, arising out of the accident which happened on June 17, 1950, in which Mrs. Ernest Updike and her daughter, Joyce May Updike, were killed, and threw himself upon the mercy of the court. The court heard the evidence of the Commonwealth, and the testimony of the employer of the defendant who stated that Dearing had been in his and his predecessor’s employ for a total of 19 years and that he had a good reputation.
After hearing this evidence and the statements of the attorneys, the Court sentenced Dearing to « total of 12 years in, the penitentiary on the thi)ee counts and suspended execution of the imposition of sentence upon the condition that Dearing pay to Ernest Updike a total of $3,000.00 at the rate of $25.00 per month over a period of ten years and upon the following further condition* which are the general condition* of all paroles:
1. That he, the defendant pay all costs of the case.
