corporation coming under the provision of thii^OSHf' I make application for license upon forma preaeribed by the Treasurer of Rappahannock County, wad upon payment of the required tax shall be issued as evidence, tins or tags which shall be conspicuously placed upon the front or rear of the vehicle so licensed, in such manner as to be plainly visible in the manner prescribed ; for State license tags. Failure to display such tins or tags shall be a violation of this Ordinance, even though the license tax has been paid. NO such license tin or tag shqll be placed upon any vehicle other than that for which it was issued. But such tins or tkgs may be transferred from one vehicle to another in same manner and under the same .conditions as provided by the laws and regulations governing the transfer of State license tags.
Section 7. The revenue derived from all County motor vehicle licenses under this law shall be paid into the General Fund of the County.
Section 8. LOST TAGS: A duplicate tin or tag shall be issued upon affidavit of the applicant that the original tin or tag has been lost. The charge for a duplicate tin or tag shall be Fifty (0.50) Cents.
Section 9. PERSONAL PROPERTY TAXES: No vehicle taxable under this Ordinance shall be locally licensed unless and until the applicant for such license shall have produced before the said Treasurer, or such agent, satisfactory evidence that all personal property taxes upon the vehicle to be licensed Have been paid, Which personal property taxes have been assessed or are assessable against such applicant.
Section 10. EXEMPTIONS: Nothing in this Ordinance shall be construed to require a license tax of a person, firm or corporation exempted under the provisions of the laws of the State of Virginia.
Section 11. RECORDS: The County Treasurer shall keep a record of each such license tag issued by him, showing the number of such tag, the person to whom it was issued, the make, model, and engine number of the vehicle for which such tag is issued, and the State license number of such vehicle.
Section 12. OFFENSE: No person, corporation, firm or partnership, resident or non-resident, shall:
a. Operate or permit a motor vehicle, trailer or semi-trailer controlled by such person, corporation, firm or partnership to be operated upon the streets, highways, or reads within said County which does not have attached thereto and displayed thereon the proper Rappahannock County license plate or plates as required by this Ordinance.
b. Display, cause or permit to be displayed or to have in possession any Rappahannock County license plate, knowing the same to be fictitious or to have been cancelled or altered.
c. Lend or knowingly permit the use of one not entitled thereto, of any Rappahannock County license plate.
Section 12.1. It shall be unlawful for any owner of a motor vehicle, trailer or semi-trailer, to display upon such motor vehicle, trailer or semi-trailer, any Rappahannock County license plate after the expiration date of such license plate. Violation of this Section (12.1) shall constitute a separate misdemeanor and be punishable by a fine not exceeding twenty dollars (829.00).
Section 13. PENALTIES: Any person violating any provision of this Ordinance for which no other penalty is provided, shall be guilty of a misdemeanor, and upon conviction thereof, shall be punished by a fine of not to exceed the sum of Three Hundred ($300.00), and by confinement in jail not to exceed the term of thirty (30) days, either or both; and trial of all violations of this Ordinance shall be enforced by proceedings before the County Court of Rappahannock County, Virginia, in the manner and with like right of appeal as is provided in misdemeanor cases; and the sheriff and all deputies and police officers of Rappahannock County are hereby authorized to issue summons in writing to violators of this Ordinance for their appearance before said Court. AH fines collected from any person, firm, or corporation for violating any provision of this Ordinance, upon conviction thereof, shall be credited to the general fund of the County and deposited by the County Treasurer in the same manner as that prescribed by other county monies.
Section 14. IN CASE ANY PART OF THIS ORDINANCl ^DECLARED INVALID: If any section, phrase or part of thi ■Ordinance should ,for any reason, be held invalid by a Court o competent jurisdiction, such decision shall not affect the remainde of the Ordinance, and every remaining section, clause or par thereof shall continue in full force and effect.
Section 15. REPEAL. All ordinances or portions of ordinances in conflict with this ordinance are hereby repealed to the extent of their conflict.
Section 16. EFFECTIVE DATE: This ordinance shaH be effective on and after 12:01 a.m. on November 8, 1962.
Section 17. PUBLICATION: The Clerk is directed to publish the foregoing proposed ordinance, together with notice of the Board s intent to adopt the same, once a week for four (4) suecessive weeks in the Rappahannock News, a weekly newspaper published at Washington, Virginia ,in said County of Rappahannock; and the Sheriff is directed to post said proposed ordinance at the
