“Why does Mrs. Baumgardner have the right to decline and nobody else does?” asked Mrs. Latham.
Carter answered that Mrs. Baumgardner had taken a combination grade before so he had honored her request not to be assigned there again.
Following about an hour in executive session, first with both Mrs. Baines and Carter and then without either of them present, the School Board came back into open meeting. Mrs. Massie read a section from School Board law that stated the assignment of teachers was the responsibility of the division superintendent. “I think this matter has been taken care of,” she stated, and repeated her reading from the statute.
At the close of the meeting, Mrs. Baines asked if the purpose of the School Board as outlined in the grievance procedure took precedence over the law?
“No, the law takes precedence,’’ Bloomer replied.
“Then, in effect, the grievance procedure is null and void,’’ Mrs. Baines countered.
‘‘An item that is a matter of law is not grievable,” responded Bloomer.
He ~ explained later that Mrs. Baines’s assignment to the fifth and sixth grade combination class had been made jointly between Principal Carter, Assistant Cuperintendent Hogan and himself and would stand.
