Barney Vierling, who lives on the Jordan River downstream from Goode’s tract, asked the Supervisors if the county intended to pay for any run-off damage incurred on his property from the subdivision. “There’s no place else for the run-off to go but down the Jordan,” he stated.

Chairman Luke replied that Goode would have to meet “pretty stringent” runoff control criteria under the county’s erosion and sedimentation control ordinance. He added that the Jordan had already suffered run-off damage from the previous agricultural activities on the property Goode purchased and claimed that Goode’s plans for controlling erosion would actually improve conditions.
