Davis’s latest threat of a suit against the county for mileage reimbursements that he deems improper wasn’t made publicly. Instead, the Commonwealth Attorney provided the Supervisors with a memorandum that stated he would be forced to take legal action if improper mileage payments continue. “Otherwise, I will be guilty of malfeasance in office. Please don’t force me,” he concluded in the memorandum.
New Forms?
At Thursday’s meeting, Supervisors J. R. Latham questioned an account item for mileage forms printed by the Culpeper Star Exponent. He asked Supervisor Chairman E. P. Luke if the county was substituting the $128 worth of forms ordered by Davis for the type currently used by the county. Luke replied that the forms were not being changed..
Sheriff Buntin said later that he couldn’t use the forms because they included notations disallowing payments for policing or { checking residences unless a complaint has been received that a crime has been committed or is about to be committed.
He said he also objected to the wording on the disallowance of payment for travel from home to office and return, travel from office for meals and return and private use of automobile. Buntin said the inclusion of this on the new forms makes it sound as if these are current practices of the Sheriffs Department when in fact they are not and have never been.
