Attorney Douglas Baumgardner, representing the Rappahannock Ski Corporation, has requested Judge Carlton Penn to delay his ruling on the validity of sections of the Rappahannock zoning ordinance until after the Supervisors act on ordinance amendments proposed by Commonwealth Attorney George Davis.
In a letter addressed to Penn dated Aug. 8, Baumgardner noted that Penn gave the Ski Corporation 21 days from July 24 in which to submit memorandum of authorities in support of the ski corporation's allegation that the zoning ordinance standards for the Board of Zoning Appeals to issue special use permits are “conclusory, indefinite and therefore, null and void.” Baumgardner also noted that Penn allowed the Ski Corporation to amend its pleadings to allege that the
