The Rappahannock Board of Zoning Appeals held two packed public hearings on the permit application. (Both the ski area and the BZA refused to accept Commonwealth Attorney Davis's contention that Moore could have all the uses listed in the permit request as a matter of right.)
Subsequently, the BZA voted unanimously to dens the permit application in its entirety, including denial of the right to continue skiing. Although there was some initial confusion over what the BZA's decision had been — to turn down the Alpine slide or turn down everything listed in the application—chairman Josel Gardiner and other BZA members later emphasized that the vote had been to deny the total application.
