The Rappahannock Chapter of the Izaac Walton League filed suit on Wednesday against the county Board of Supervisors, seeking to overturn the ski area zoning ordinance amendments adopted in September.

“We feel some unfortunate procedural shortcuts were taken,” said Chapter president Bob Dennis, “and we want to assure that any irregularities are cleared ud before they become habitual loopholes in the county decision-making process.”

Dennis emphasized that the Chapter’s suit is intended as “friendly action aimed at clarifying the roles of county government units and citizens alike.

"Like many other Rappahannock residents, we are concerned about the vague and sweeping language of the amendments, their internal inconsistencies, and the degree to which they potentially deny county citizens a voice in Rappahannock’s future,” said Dennis. “We hope that our action will lead to new language which will actually improve upon that of the original clearly-stated ordinance.”

Thfc amendments referred to in the Izaac Walton Chapter’s suit were adopted by the Supervisors on September 7 for the stated purpose of resolving litigation between the Supervisors, the Rappahannock Ski Corporation and the Rappahannock Board of Zoning Appeals. Proposed jointly by Commonwealth Attorney George Davis and Douglas Baumgardner, attorney for the Ski Corporation, the amendments allow "outdoor recreation, including, but not limited to skiing, swimming pools, tennis courts and gravity slides" as a use permitted by right in all areas of the county where slopes are greater than 14 per cent a.;d in all areas zoned general business or commercial.
