On September 7, the Supervisors voted to approve the amendments in question with no recommendation from the Planners and despite a request from the Planning Commission for additional study time.
The suit argues that the Supervisors’ failure to follow the procedure set forth in the Code of Virginia allowing the Planning Commission up to 90 days to make recommendations contravenes a mandatory requirement, violates due process and renders the amendments void and unenforceable.
In its suit, the Rappahannock Chapter of the Izaac Walton League petitions the court to set aside the zoning ordinance amendments and to restrain the Supervisors from taking any action to enforce the amendments, including issuing any building permit.
