"The General Assembly has expressly established the criterias which must be met by candidates for county school board membership." Coleman wrote in his October 4 opinion. "Therefore. the School Trustee Electoral Board lacks legislative authority to publish additional eligibilityrequirements."
According to Coleman, the General Assembly established that a school board member "shall be a bona fide resident of the magisterial district or town from which he is elected." In addition, wrote Coleman, the Code prohibits a county or state officer and supervisors and their relatives from sitting on the county school board in certain circumstances.
Finally, the Code permits certain enumerated classes of federal employees to serve in county positions. Coleman noted in listing all the qualifications for school board member covered by the General Assembly in the Virginia Code.
The legal opinion from Coleman was sought bydelegate George Beard at the request of several Rappahannock constituents.
