Sen. Bird’s bill also specifies penalties — jail time, fines and license suspension — for second and thirdtime offenders.
Those convicted of a second offense within five years of their first conviction would spend at least 30 days and as much as a year in jail, pay between $1,000 and $2,000, and lose their license for at least three years, without eligibility for a restricted license.
Those convicted of a third offense within 10 years would spend six months to a year in jail, pay $2,000 to $3,000, and lose their license for at least 10 years.
Sen. Waddell’s bill to make drinking while driving a crime has come before the Assembly before and failed, but he says it is different from previous “open container” bills, which he says were “more far-reaching” than his proposal.
It states: “It shall be unlawful for any person to consume an alcoholic beverage while driving or operating a motor vehicle...”
His resolution, which he introduced on Tuesday, proposes a sevenmember subcommittee to study the possibility of raising the minimum driving age or issuing restricted licenses to young drivers.
