Virginia is one of 13 states that do not require hunters to wear blaze orange. The state recorded seven deaths and 42 injuries (12 self-inflicted) from hunting accidents in the last six months of 1985. None of those killed and only five of those injured by someone else were wearing blaze orange when they were shot.
Mandating use of blaze orange would not absolve hunters from responsibility if they shot someone not wearing it, because the bill say& that a violation of the blaze orange requirement could not used as evidence of “negligence or contributory negligence” in a civil lawsuit.
But at least one person on Monday worried that the law might make it more dangerous for people walking in the woods without blaze orange clothes.
“We wouldn’t like to hear, ‘If it’s not wearing blaze orange and it’s moving, go on and shoot it’,” said Georgia Herbert, representing the Warrenton-based Piedmont Environmental Council.
“The hunter is responsible for his target,” responded Jack Randolph of the game commission.
The game commission trains 25,000 people a year in hunter safety, Mr. Randolph said, but it hasn’t been able to induce hunters to voluntarily wear blaze orange.
