The commissions agree on a majority of the proposals. Nonetheless, a major difference concerns the governor's commission’s recommendation that juveniles charged with violent crimes be tried in adult court or circuit court systems.
Commission on Youth members, however, point out that current law effectively deals with these situations. A juvenile judge conducts a probable cause hearing to decide whether the case should be transferred to circuit court.
Juvenile Court Judge Charles McNulty III of Harrisonburg and Rockingham County said he hasn't seen any problems with the transfer of violent charges to circuit court. Most prosecutors, he said, support the current system.
