Samuel D. Berry, 41, of Culpeper, asked the court if he could be released form the jail on bond. He was indicted in November for fraud. Judge Robertson set a $ 1,000 cash corporate surety bond for Mr. Berry, who must remain in custody until he can make that bond.
Timothy Duane Reid, 33, of Washington, asked the court to reconsider his five year sentence which he was recently ordered to serve because he violated probation. He is presently incarcerated in the Rappahannock County Jail and has completed 151 hours of community service. In a letter to the judge, Mr. Reid said, “I was wondering if there is a possibility that 151 community service hours that I worked could be considered into my sentence.” He further told Judge Robertson that this would be his first Christmas without his daughter and that he had “definitely softened up” since he had been in jail.
Mr. Luke explained that Mr. Reid was asking the court to modify the sentence that had been imposed by the same court, and that he had violated probation before by doing drugs and missing appointments with his probation officer.
Judge Robertson told Mr. Reid that he was impressed with his changed attitude but that no mitigating circumstances had been shown to allow Mr. Reid’s sentence to be modified.
