Sentencing guidelines showed that the mid-range of Mr. Sisk’s sentence would be four years and nine months. If guidelines had shown that Mr. Fletcher had suffered serious physical injury, Commonwealth’s Attorney Peter Luke pointed out, 27 points would have been added to the guidelines and the mid-point would have been seven years. Though Mr. Fletcher had received a broken scapula, rib and laceration on his head from the fight, because he did not spend the whole night in the hospital (he was treated and released), that does not constitute “serious physical injury” for purposes of the sentencing guidelines.
