Board member L.G. Zindel moved to uphold the Administrator’s decision, and the Board deadlocked on the question, with members Zindel and Robert Herrema voting for, members Alex Sharp and Matthews voting against, and member Weinberg abstaining. When, as in this case, a majority does not vote to overturn the Administrator’s decision, the decision is then upheld.
In a late development, Administrator McCarthy said that the appeal would have to be reheard by the BZA at its next meeting, due to the fact that the County Ordinance requires a public hearing on such appeals, though State statutes do not, and there was no such public hearing on the appeal at last week’s meeting.
Other business
Other matters before the BZA included a positive decision on the application by Edward and Deloris Payne for a family apartment on their property in Amissville, and a denial to approve a setback variance, from 100 to 40 feet, requested by Robert Etchells for lots in Harris Hollow. In lieu of granting this 40 foot setback from the front of the lot, the BZA granted a 50 foot setback from the rear of the lot for the home site.
