member and Inn principal Reinhardt Lynch excused himself from the deliberations and voting on the Inn’s application.
Council discussions and voting were preceded by remarks from the Mayor and from the Inn’s attorney, Lucy Ivanoff of the law firm Wharton Aldhizer & Weaver PLC, and by a public hearing.
Mayor Willis opened discussions by noting that Ms. Ivanoff had asked, in a letter dated July 2, if he would be recused from the decision because of a conflict of interest—he receives rent from the Inn at Little Washington. The Mayor said that he had discussed the issue with Commonwealth’s Attorney Peter Luke, and that he was advised by Mr. Luke that he should not be recused. Ms. Ivanoff asked again and “for the record" if the Mayor would excuse himself, and Town Attorney John Bennett responded to her by noting that Mr. Luke had reviewed the code and had consulted with the Attorney General’s Office, and they said that there was no problem with the Mayor’s participation in the decision.
Mr. Bennett then described the application for the audience. He said that the application was for three rooms on the first floor, and that the Council should consider only those 714 square feet and other “accessory and special uses will be considered later.” He expressed concern though that there was no consideration for
