In 1985 Rappahannock County became one of the first jurisdictions in Virginia to ban the land application of sludge. The County initially placed a moratorium on it, he said, and then, after a number of public hearings and discussions, the Board of Supervisors moved to enact a ban in the early 1990's.
Two years ago the Rappahannock County ban was invalidated by a Virginia Supreme Court decision that ruled that Amelia County's ban on the land application of sludge was not legal because "if a State agency rules to regulate it, then a local jurisdiction cannot ban it.'
