ORDER FOR PUBLICATION In this suit. Plaintiff. V John Lyle, is asking the court to order that he has acquired title to the property described below by adverse possession. In addition. Plaintiff is asking the court to establish the boundaries of the subject property The subject real property is located in Rappahannock County. Virginia, and is more particularly described as follows: All that tract or parcel of land located in the Hampton Magisterial District. Rappahannock County, Virginia, containing 8.7 acres, more or less And being the land that was the subject of a chancery suit entitled Sylvanus Elkins, et at v Lucy Butler, et. al.. case no 1845-246, which was filed around 1844 seeking partition of the real property A decree was entered in 1844 which divided the property among the following heirs: Sylvanus Elkins. Luretta Elkins, Ann Field Elkins. Jemina Elkins. Lorenzo Elkins. Nancy Elkins, Lucy Elkins Butler, and the children of Benjamin James Elkins as follows Andrew W Elkins. Louisa Elkins, Elizabeth Elkins. June Elkins. Benjamin Elkins, Jr. Lucy Elkins and Ann Elkins. And being the parcels currently on the taw rolls as (1) Harry Phillips, do V John Lyle: 5 5 acres, TM. # 30-25A: (2) Henry Williams. Sr Estate, do V. John Lyle: 2 acres, T M. #30-26. and (3) Jemina Elkins, oo V. John Lyle: 1.25 acres. TM. #30-21B. Plaintiff is asking this Court to order that legal title to the proj^erty be transferred to V John Lyle. Plaintiff by virtue of Plaintiff 's adverse possession of the subject property for the requisite fifteen yeairs. and to order that the plat of survey attached to this Complaint correctly sets forth the boundaries of the subject property as shown in blue on Exhibit R attached to the Complaint. It appearing that an affidavit has been made stating that there are or may be persons interested in the subject matter of this suit whose names are unknown, namely the widows, widowers, heirs, devisees and successors in title of Hubbard Elkins or Hubert Elkins and making said persons defendants by the general description of ■parties unknown ’ and an affidavit being made and filed stating that they are unknown, it is. therefore ORDERED.
