The Fauquier Supervisors have also authorized Bean to request a stay of construction, but has not because he wanted to see how Judge Snead would rule. Bean also wants to discuss with the Supervisors the question of posting a bond when requesting a restraining order against Vepco. The county does not need to post a bond, but Bean wants to protect the county against a possible suit for damages if the Supreme Court rules in favor of Vepco after delaying construction. The state high court ruling could take up to a year.
Bean, Foley and the Supervisors are expected to discuss the bond question and the possibility of also appealing Judge Snead’s ruling at the Board’s meeting on August 14. So far, the Supervisors have only allocated $10,000 for the powerline battle.
