I did object to refiling the plan under Article 128 because I did not believe that it could be legally filed under that Article, and the Board has since concurred; and I have therefore filed an amended request under Article 7, submitting to the guidelines of Article 12B.
If Article 7 is applicable, then Article 13 of the Ordinance is automatically applicable despite the fact that the Board insisted that I comply with its terms.
One of these terms, Article 13-2. states “Following the zoning for any such use or issuance of a Special Use Permit for any such use, and prior to the issuance of any Building Permit for any use identified under this article, a detailed plan of development shall be submined to the Administrator.”
