McNear noted that the property was located on an old one lane countymaintained dirt road. He said that he wasn’t sure how large the right-of-way was, adding that he knew it didn’t total 50 feet.

BZA member Hal Forward maintained that the Board needed to know the legal right-of-way owned by the county before reaching a decision.

“Probably the county doesn’t know,” commented Admiral Gardiner.

“Then how can we know?" asked Forward. “I personally don’t see anything objectionable (in approving Gersten’s proposal). The only thing I object to is we don’t know what we’re doing.”

E. P. Luke, who lives near Gersten, told the BZA members that the cabin was over 100 years old and had existed before the Highway Department put in the road. The road could have been put anywhere, he continued, and if Highway personnel had felt the house was too close, then the road would have been moved over further.
