Gardiner asked if Luke wanted the executive meeting before or after adjournment.
The Chairman of the Board of Supervisors explained, briefly, a provision of the Virginia Freedom of Information Act that requires a motion and vote for executive session be made in open session. Then, he told the BZA members, they can come back into open session and adjourn.
Luke stayed for only a few minutes of the closed session that continued with the Commonwealth Attorney and four BZA members for about a half hour after the Supervisor’s departure.
At the close of the executive session, Gardiner reported that the only action taken had been to remove the $ requirement placed on Elmer Jenkins earlier in the meeting. Gardiner explained that Jenkins does not have to come back before the Board for a permanent sign permit since county ordinances allow him to erect a sign by right in a business district if the sign does not exceed 20 feet.
